General Terms of Use and Sale

These General Terms of Use and Sale (the "Terms") govern access to and use of the Frenchee platform, as well as sales of services concluded through it. By creating an account, booking a lesson, or making a purchase, the user acknowledges having read these Terms and accepts them without reservation. They prevail over any other document. The applicable version is the one in force on the date of the order.
1. Definitions
"Platform": the Frenchee website and services, accessible at frenchee.online. "Student": any adult natural person holding an account who books or purchases services. "Teacher": a French-language teacher listed on the Platform who provides lessons. "Private lesson": an individual video-conference session between a Student and a Teacher. "Group lesson": a collective, level-based session bringing together several Students. "Pack": a prepaid set of private lessons attached to the Student's account. "E-learning": the self-study learning modules available on the Platform.
2. Purpose and publisher
The Platform is published and operated by LA LUCARNE, a SARL (limited liability company) with share capital of €2,000, whose registered office is located at 86 rue Pierre et Marie Curie, Bâtiment A, 34430 Saint-Jean-de-Védas (France), registered with the Montpellier Trade and Companies Register (RCS) under number 928 002 484, intra-Community VAT number FR85928002484 (hereinafter "Frenchee"). Frenchee connects Students with French-language Teachers and provides the teaching services described below. Contact: contact@frenchee.online.
3. Registration and account
Registration is free and reserved for adult natural persons. The Student guarantees the accuracy of the information provided and undertakes to keep it up to date. The Student is solely responsible for the confidentiality of their login credentials and for any activity carried out from their account. An account is strictly personal and may not be transferred. Frenchee may suspend or close an account in the event of a breach of these Terms.
4. Description of services
Frenchee offers: (i) individual private lessons by video conference, booked online for a chosen time slot; (ii) level-based group lessons; (iii) self-study e-learning modules, some parts of which are free and others paid. Frenchee is bound by a duty of best efforts (obligation de moyens) as to the educational quality of its services. Video-conference lessons are provided via a third-party tool (Google Meet).
5. Price
Prices are stated in euros, inclusive of all taxes (TTC), and are those displayed on the Pricing page at the time of the order. They include VAT at the applicable rate (20% in France). Private lessons may be purchased individually or as prepaid packs with tiered pricing (the larger the pack, the lower the price per lesson). Services are payable in advance. Frenchee reserves the right to change its prices at any time; the price applicable is the one in force at the time of the order.
6. Prepaid packs, group lessons and validity
Private lessons are sold individually (1 lesson) or in packs of 5, 10, or 20 lessons. Each pack credits the Student's account with the corresponding number of lessons, which can be used to book private lessons. Validity period from the date of purchase: 3 months for a single lesson purchase and for the pack of 5, 6 months for the pack of 10, and 12 months for the pack of 20. Lessons not used by the expiry date are forfeited and give rise to no refund. This is not a subscription: no recurring charge is made. Group lessons are booked session by session and do not draw down lessons from a pack.
7. Payment terms
Payment is made online by credit or debit card via our payment provider, Stripe (Stripe Payments Europe, Limited). Frenchee never has access to full card details, which are processed and secured by Stripe. The order is final only once payment has been effectively confirmed. An invoice is made available to the Student in their personal account area.
8. Right of withdrawal
In accordance with articles L221-18 et seq. of the Code de la consommation, a consumer Student is, in principle, entitled to a 14-day period within which to withdraw. However, this right cannot be exercised (article L221-28 of the same Code): for lessons fully performed before the end of the withdrawal period with the Student's prior express agreement and waiver of the right of withdrawal; or for e-learning digital content supplied immediately after purchase, where the Student has expressly consented to such immediate supply and has waived the right of withdrawal. To exercise the right of withdrawal where applicable, the Student must send an unambiguous request to contact@frenchee.online; the refund is made within 14 days.
9. Cancellation, rescheduling and no-shows — private lessons
The Student may cancel or reschedule a private lesson free of charge up to 24 hours before it is due to begin. In that case, the lesson is restored: re-credited as a prepaid lesson if it came from a pack, or refunded in euros to the payment method used if it was purchased individually. A booking covering several consecutive time slots constitutes a single lesson and is cancelled as a whole. After this 24-hour deadline, the lesson is considered due and is neither refunded nor rescheduled. If the Student fails to attend, the lesson is deemed used. If the Teacher fails to attend or cancels, the lesson is fully refunded or rescheduled, at the Student's choice.
10. Group lessons
Group lessons are subject to a minimum number of participants. If this threshold is not met, Frenchee may cancel the session, in which case the Student is fully refunded. The Student may cancel their registration for a group session up to 24 hours before it begins (refund or restoration depending on the purchase method); after this deadline, the session is due.
11. Rewards and vouchers
Frenchee may grant discount vouchers expressed in euros (for example as part of a referral program). These vouchers are personal, non-transferable, valid on Platform services only, non-convertible into cash, and non-refundable. Their terms and validity period are specified at the time they are granted.
12. E-learning
The e-learning modules include a free portion and paid premium content (for example, unlocking a complete level). Access to premium content is digital and provided immediately after purchase (see Article 8). Certain written or oral submissions may be corrected by Platform teachers, within a reasonable time and without guarantee of outcome.
13. User obligations
Students and Teachers undertake to behave courteously and respectfully. In particular, it is prohibited to make unlawful statements, infringe the rights of others, or disrupt the operation of the Platform. It is prohibited to circumvent the Platform's payment system or to arrange paid services outside of it. Frenchee may suspend any account in the event of a breach.
14. Reviews
After a lesson has taken place, the Student may leave a review. Reviews reflect the opinions of their authors. Frenchee may remove any review that is manifestly unlawful, abusive, or unrelated to the service provided.
15. Liability
Frenchee is bound by a duty of best efforts (obligation de moyens) and does not guarantee any specific educational outcome. Frenchee's liability cannot be engaged in the event of force majeure, failure of networks or third-party tools (in particular video-conferencing tools), or non-compliant use of the Platform. To the extent permitted by law, Frenchee's liability is limited to the amounts actually paid by the Student for the service concerned.
16. Intellectual property
The Frenchee brand, the Platform, its visual identity, its educational content, and its code are protected by copyright and trademark law. Any reproduction or representation, in whole or in part, without prior written authorization, is prohibited.
17. Personal data
The processing of personal data carried out within the Platform is described in the Privacy Policy, which complies with the GDPR and which the Student is invited to consult. Contact: contact@frenchee.online.
18. Complaints and consumer mediation
Any complaint may be sent to contact@frenchee.online; Frenchee endeavors to respond as promptly as possible. In accordance with article L612-1 of the Code de la consommation, the consumer may use a consumer mediator free of charge with a view to an amicable resolution; the contact details of the competent mediator are provided upon request. The European Commission also provides an online dispute resolution platform: ec.europa.eu/consumers/odr.
19. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts shall have jurisdiction. The consumer may choose to bring proceedings before either the court territorially competent under the Code de procédure civile or the court of the place where the consumer resided at the time the contract was concluded.
20. Amendment of these Terms
Frenchee reserves the right to amend these Terms at any time. The version applicable to an order is the one in force at the time the order is placed. Substantial changes will be brought to users' attention by any appropriate means.
